James Gargiulo Minor (2-lot) Subdivision
West Glenville Road and Green Corners Road (Preliminary)
This proposal calls for the subdivision and reconfiguration of two lots into three lots. This subdivision is being proposed in order to partition off a carriage house from the primary residence at 391 Green Corners Road. The properties are primarily zoned “Rural Residential and Agricultural,” with a New York State Freshwater Wetland on the property being zoned “Land Conservation”.
Pete Daly, realtor, was in attendance on behalf of the applicant.
M. Carr said the Board doesn’t have any serious issues with the lots. They are just shaped a bit strangely, but said the applicant is doing what they had to do, given that the landowner illegally established a 2nd residence (a carriage house) on the same parcel as the primary single-family home, necessitating a subdivision. The Town’s Zoning Ordinance does not permit two single-family residences on the same parcel.
T. Yosenik had concern for the very long, shared driveway.
P. Daly said that the driveway exists and the 2 structures are using one shared driveway currently.
P. Huff stated that on the one new lot, the new owner may want to construct their own driveway, although this may be expensive, given the distance and the wooded setting.
K. Semon wants to know about egress/ingress for the shared driveway.
P. Daly said that there is a separate utility service for the carriage house. Service comes from Green Corners Road and is underground.
K. Semon stated that the 2 owners will need to come to terms on a maintenance agreement for the shared driveway.
M. Carr said that the PZC is requesting a maintenance agreement or easement, and a determination of what the final arrangement on the egress/ingress will be for that parcel.
P. Borisenko stated that we don’t specify where the driveway is to be located. Usually they will show us on the subdivision plan, but we don’t want them to be locked into a particular driveway location necessarily.
M. Carr said that the Commission can ask for identification of the specific location. We will not mandate it, but we could.
A question was then asked as to what the address of the new parcel would be. P. Borisenko said that the address comes from Schenectady County Communications, who manages the County’s E-911 system. The address will be assigned based on the driveway’s location on the road, not on the position or orientation of the house.
K. Corcoran stated that when the Commission held their agenda meeting two weeks ago, there was the possibility of a pending sale of the property that would render the subdivision unnecessary, because the carriage house residence would be taken out of use. When asked, Pete Daly indicated that the sale is in the works, but the specifics have not yet been nailed down.
MOTION
In the matter of the preliminary minor 2-lot subdivision application by James Gargiulo to be located at West Glenville Road and Green Corners Road, the PZC finds that this application will not result in a significant potential adverse environmental impact. Consequently, the PZC issues, as SEQRA lead agency, a Negative Declaration.

MOTION
In the matter of the preliminary minor subdivision application by James Gargiulo for a minor 2-lot subdivision located at West Glenville Road and Green Corners Road, the PZC hereby conditionally approves the preliminary application.
The Commission hereby schedules a public hearing for November 9, 2015 to consider the final minor subdivision application.
Conditions of preliminary subdivision approval are as follows:
- Details on the driveway maintenance agreement/easement for the shared driveway need to be submitted for PZC review.
- A final determination needs to be made regarding the location of the proposed driveway for the proposed new parcel. It must be determined whether the driveway will be located on West Glenville Road or Green Corners Road.
The commission hereby schedules a public hearing for November 9, 2015 to consider the final minor subdivision application. However, in order for the Commission to schedule a public hearing on November 9, 2015, nine (9) copies of the revised subdivision map and/or requested information must be submitted to the Town of Glenville Planning Department no later than 14 calendar days prior to the public hearing.

Jason Berggren for Current Electrical Systems Inc. Site Plan Review
NYS Route 5 and Washout Road (Preliminary)
The applicant is proposing to establish an electrical contractor’s office, warehouse and yard for the storage of equipment and materials on a vacant 4.6-acre parcel on the northeast corner of Amsterdam Road and Washout Road. The property is zoned “Highway Commercial”.
Applicant Jason Berggren was in attendance. He stated that he wants to erect a steel structure for his established business. He also stated that the structure will have a concrete floor and vehicles will be stored inside the building.
M. Carr stated that the applicant will need to make a few additions to the plan, specifically a narrative to address erosion and sediment prevention.
K. Corcoran stated that revised site plans were delivered tonight and all Commission members have them in their packet, dated October 16, 2015.
M. Carr stated that the new site plan does have the narrative, and a location map has been included. He then asked the applicant if he designated outdoor storage on the map.
J. Berggren said yes.
M. Carr asked the applicant if he does only commercial electrical work. Mr. Berggren responded yes.
M. Carr asked if fuel will be stored on the premises. The answer was no. He also asked if hazardous materials were to be stored on site, and again, the answer was no. There will be no cleaning chemicals, degreasers, PCPs, transformer oils, pesticides, etc. on the property.
M. Carr asked about the applicant’s plan for lighting.
J. Berggren said it is all on the new site plan. They will be using LED lighting directed down or towards the building.
When asked, J. Berggren answered that there is an existing well on the property which will be used for his business. The well is 203 feet deep, and it is cased.
M. Carr asked about the water quality of the well. Mr. Berggren responded that the quality is good to excellent. Sulfur is not an issue.
M. Carr asked about the business operations. Is this a warehouse/office with no customers coming in? Mr. Berggren said that there will be no customers on site.
K. Semon asked about waste disposal/dumpsters. Where will the dumpster be placed on the site?
J. Berggren stated he didn’t know where yet. It will be outside, out of sight.
M. Carr stated it needs to be shown on the site plan, with a buffer i.e. fence, shrubs, etc.
M. Carr asked about neighbors, and if this business might impact adjacent residents. Mr. Berggren noted that there is an existing house to the rear/north, but there is a significant wooded buffer between us and this residence.
M. Carr asked how many vehicles there will be on the property, for the business. The site plan shows parking spaces, is that enough?
J. Berggren stated they have enough spaces. He has a couple of vans, 3 pick-up trucks and a boom truck. All vehicles will be stored inside.
M. Carr asked if there will be sanitary facilities. The answer is yes.
M. Carr asked about the results of the soil percolation test. Mr. Berggren responded that the perc test results were excellent for an on-site septic system.
T. Bodden asked Mr. Berggren where his business is presently located. He answered that he currently operates out of his Glenville home.
A question was asked of the applicant what the new structure would look like. K. Corcoran drew the PZC members’ attention to elevations that were submitted previously. The PZC recalls not having any concerns about the building design.
M. Carr asked about soil suitability for building construction. The applicant answered that the soils are good.
M. Carr asked how the building would be heated. The applicant said by either radiant heat in the floor or infiltrated. He stated that they will be using natural gas.
K. Semon stated that the structure has 6 rooms and a main floor. He asked what these rooms will be used for. Mr. Berggren answered that these will be offices. When asked, he responded that no one will be living on the premises.

A question then came up regarding existing accesses on the property; one in the back and one in the front. The applicant was asked if he was going to be storing anything in these locations. The applicant answered no. He also noted the presence of an existing curb cut on Route 5.
